New practice in the OHIM opposition proceedings

As from April 1 2012 the Office for the Harmonisation of the Internal Market (OHIM) set a new practice in opposition proceedings when notifying the opposition to the applicant when the opposition is based on a Community Trade Mark (CTM).

More specifically, when the opposition is based on a CTM, the Office attaches to its letters the corresponding CTM-online extract. However, due to technical constrains, when the CTM on which the opposition is based is in colour, the Office’s letter must necessarily be sent by post to the applicant. This is leading to unnecessary delays in proceeding communications to the applicant. For this reason the Office will no longer send the corresponding CTM-online extract attached to the Offices’ letters but will add a link to CTM Online database. This would allow the applicants to download information about the earlier CTMs and will spare the parties precious time.
